Mingarry Lodges: Terms and Conditions (27 June 2011)
- BOOKING
- The properties let as Mingarry Lodges are to be used for the
purposes of a holiday let to which Section12 (2) and paragraph 8
of Schedule 4 of the Housing (Scotland) Act 1988 apply. The booking
agreement confers a right to occupy the accommodation for the agreed
period only.
- The letting period runs from 4pm on the day of arrival until
10am on the day of departure.
- The person making the booking will be responsible for ensuring
that the conditions of let are upheld.
- Only the number of people on the booking form may occupy the
booked accommodation.
- Sub-letting or assignation of the let is prohibited.
- When you submit an online booking you will receive an automatically
generated booking summary by email to the email address you have
provided in the booking form. This does not form a contract between
us.
- A contract will only arise when your booking is confirmed in
writing by us via a letter of confirmation sent by post or email.
Bookings will only be confirmed upon receipt of a deposit of 20%
of the total amount due.
- PAYMENT OF BALANCE
- The balance of your rental cost is payable five weeks prior
to your arrival.
- Where payment in full has not been made by this date, we reserve
the right to cancel the booking and cancellation charges as detailed
below will apply.
- If you book within five weeks, we will require full payment
at the time of booking.
- CANCELLATION BY GUESTS
- In the event of your needing to cancel, the following conditions
and charges will apply:
- Cancellations must be made in writing and by telephone
- Up to five weeks prior to arrival - Deposit
- Between five and two weeks - 75% of the total charge
- Within two weeks - 100% of the total charge
- INSURANCE
- It is your responsibility to ensure that you have adequate comprehensive
insurance cover for you and all members of your party. Under no
circumstances will the owners be responsible for loss of life, personal
injury, medical expenses, accidents or forfeited deposits or damage
to property and/or motor vehicles howsoever caused. Tenants and
their guests are recommended to insure against these risks.
- CANCELLATION BY US
- To accept that should the property, subsequent to booking, become
unavailable through any cause, the owner’s liability is limited
to the repayment of any rent already paid.
- FORCE MAJEURE AND EVENTS OUTSIDE OUR CONTROL
- Should the accommodation become unavailable due to any circumstances
beyond our control (eg theft, damage, riots, war or threat of war,
terrorist activity, civil strike, natural or nuclear disaster, industrial
dispute, adverse weather conditions, fire, epidemic or health risk
and similar factors beyond our control) our liability is limited
to the repayment of any rent already paid.
- ELECTRICITY
- In support of our environmental policy we encourage guests to
turn heating off or down when not required. Please note that excessive
use of electricity may be charged for.
- WIFI
- Complimentary broadband internet wifi connection (up to 2Mbps)
will be available in daytime and evening hours and is intended for
general web browsing and for checking email. The service is not
guaranteed and if it is unavailable for any reason you have no claim
against us. Use of wifi is at your own risk and using your own equipment.
All equipment must have an up to date and functioning firewall and
anti virus software. The security code/passphrase must not be disclosed.
The service must not be used for any unlawful, malicious or immoral
purpose.
- COMPLAINTS
- In the unlikely event that you should have a complaint about
Mingarry Lodges please inform us immediately and we will endeavor
to rectify the matter. We will not accept liability for any dissatisfaction
or other complaint not reported to us during your stay.
- YOUR RESPONSIBILITIES
- To respect and look after the accommodation during your stay
and to leave the property clean and tidy, with full inventory. We
reserve the right to make a charge for additional cleaning if the
property has not been left in reasonable condition.
- Not to take cycles or large sport equipment into the lodges.
- To report any defects or breakages as soon as possible. Please
note that damage to property and contents will be charged for.
- To leave the hired premises secure if left unoccupied during
the period of let.
- You are expected to show due consideration for other people,
not to abuse the property, or display rude, dangerous or offensive
behavior towards the owner, caretaker or other third party. Possession
of the property may be refused or you can be asked to leave before
the end of the holiday if your behavior is deemed inappropriate
or offensive. If this happens we will treat your holiday as being
cancelled by you and you will not be entitled to a refund of your
holiday cost or compensation.
- SMOKING
- For the comfort and safety of all our guests holiday lodges
are NO SMOKING premises. Smoking is strictly prohibited in or around
the lodges, including on the veranda.
- FIRE SAFETY
- The use of candles, naked flames and barbecues are prohibited
in and around the cabins, including on the verandas.
- PET POLICY
- Dogs, cats and other pets are NOT permitted in the lodges or
on site.
- PARKING
- Parking is provided for one car per party, unless agreed otherwise
in advance by us via a letter sent by post or email.
- ACCESS TO THE PROPERTY
- The Owner has the right to enter the property at any reasonable
time for the purpose of inspection, repair work, etc. We will advise
you of the date and time of any time access is required.
- WEB SITE
- Our web site is a guide to the quality and description of Mingarry
Lodges. Changes to facilities or furnishings may be made without
notice. No liability is accepted for unintentional errors, mistakes
or omissions, which may arise as a result of subsequent changes.
